As a person, you have to obtain an administration order when the creditors are harassing you of taking a legal action against you, or if there is a county court decision against you. If minimum two creditors are intimidating you of taking a legal action and the money you owe is not more than 5000 pounds, you should go for an Administration Order.
If you are in debt and your creditors are harassing you for repayment, you can get legal counsel to help you negotiate a repayment plan with your creditors. You can also apply for IVA in your local county court. Alternatively, you can apply for an administration order. It is better to apply for an administration order than getting threats from your creditors. Nobody likes to face the embarrassment, in front of his family or colleagues, from the creditors.
You can apply for an administration order by applying to a county court. You are required to fill a court form (N92), which is obtainable from your local court office. You need to enlist all your debts, which should not exceed five thousand pounds. Each individual has to file separate forms. In case a couple has a joint debt, it has to be divided and separate forms need to be filed.
Your income should be mentioned clearly on the form. The court will arrange a personal hearing and assess how much money you will be paying every month to sort out your debts. Then the court will give you an administration order, according to which you will be bound to make payments to the court. The court will subtract ten% as handling charges. After paying off your debts completely, you can apply to receive a Certificate of Satisfaction that costs just 10 pounds.
In case there are any changes in the circumstances, and you are not able to make the monthly payments, you must inform the court. The court will review your application and may reschedule your payments. If you do not make your payments, the court may revoke the administration order. In these circumstances, your debtors can pursue you for full repayment and can take legal action against you.
If you get an administration order, it would help you in fending off your creditors, who would not worry you for payments. Another good thing is that you would not have to pay a single payment every month instead of paying all the creditors separately. One more benefit of taking an administration order is that the creditors must agree to the money that is being owed, and they cannot put in any additional interest to it.
If you have accumulated non-priority debts of less than five thousand pounds, but you cannot pay them in one go, or cannot even come up with the monthly repayments for each one of the creditors. You should apply for an administration order. The court examines your financial situation, your financial responsibilities and decides according to what you can afford to pay.
Just after you realize that it is difficult for you to pay your debts and you are being harassed by your creditors, it is better to apply for an administration order.
