A trip to hospital is expected to promote recovery, so it is understandable to feel angry when you leave hospital with a worse injury than you went in with.
Hospitals have an extremely busy and fast-paced environment that makes accidents more likely. Slips, trips and falls, injuries sustained from faulty equipment, illness from hospital infections, and food poisoning, as well as accidents while being transported to or from hospital in an ambulance, are most commonly sustained.
Hospital infections are a major player in the litigation industry since their recent increase. MRSA directly causes the deaths of 1,000 in Britain each year, leaving others with debilitating illness and life-long disabilities. Despite this, lawyers have had a fight on their hands in attempting to claim compensation for the victims, as it is extremely difficult to prove the source of the bacteria.
As with all public areas, hospitals have a duty of care to its patients and visitors which requires them to take appropriate steps to keep accident rates as low as possible.
Consulting an independent medical expert who does not work at the hospital in question is a good idea before taking legal action. For example, if the injury was sustained within an NHS hospital you should get a consultation at a private doctor's surgery. A solicitor can then gather evidence that you were injured from an accident at hospital and present the hospital and their insurers with a claim. They will advise you on the amount of compensation you should expect to be paid.
