Divorce for those involved can be a stressful period in life. However, it is not issued for any reason. Instead within England and Wales, the couple need to be married for at least a year before any process can start. If this is the case, then only one basic reason can allow for a divorce - the irretrievable breakdown of the marriage. This can be split into sub-reasons which are permissible in the view of the court.
Adultery is a reason - but the support of proof is required, otherwise the court will dismiss any argument. Proof is obtained either through admission or by evidence which is beyond reasonable doubt by which sexual intercourse occurred. This would result in an unendurable life beyond repair. Defining adultery does however not encompass a sexual liaison which did not include any sexual intercourse. Instead, it is defined as unreasonable behaviour.
No more than 6 months should elapse since the adultery was made aware, otherwise the court will reject any claim. And if an additional person is named - I.E the co-respondent, then the case can take longer. Therefore, before this is considered, legal advice should be gained before any decision.
Desertion is anther motive. Although rare, it basically implies an issue which is not consented by the other person - and if 2 years have elapsed, it warrants a satisfactory reason.
The area involving separation is split into 2 categories - agreement and no required agreement. In a 2 year case of separation, both spouses need to agree to the divorce. In contrast, the 5 year requires no agreement, and as such, the process can be simpler.
